Foreigners wishing to acquire ownership or co-ownership of residential real estate in Austria, require approval by provincial authorities. Nationals of EU and EEA member states are treated equally to Austrian nationals.
As a result of bilateral agreements with some third countries their nationals may also purchase properties without approval provided they have optained an exception certificate.
All other foreigners have to file a request for obtaining approval for the acquisition proving a cultural, social or economic interest in the acquisition. In any case the authorithies may refuse an approval in case impaired.
