EXEMPTION FROM THE LAND REGISTRY REGISTRATION FEE FOR THE PURCHASE OF RESIDENTIAL PROPERTY

In order to acquire property in Austria, the title of ownership has to be registered in the Austrian Land Registry. The court fee for the registration of ownership title is 1.1% of the purchase price of the property and 1.2% of the loan sum for registration of a morgage.
On 20th March 2024, the National Council approved a temporary - two-year - exemption from payment of the fees for the registration of ownership title and morgages in the Austrian Land Registry limited to the acquisition of residential property. This exemption is subject to the following conditions:
The purchase contract has been signed after 31st March 2024.
The application for registration is submitted to the Land Registry between 1st July 2024 and 1st July 2026.
The dwelling or the plot of land on which the home is to be built serves to satisfy an urgent housing need.
In case the home has to be built, it shall be occupied within three months of completion, but not later than five years from registration of the title in the Land Registry.
A loan secured by a morgage was taken out for the purchase, renovation or construction of the home.
The fee exemption applies up to the first EUR 500.000 of the price in excess of which a registration fee becomes payable.
The home be occupied not less than five years. If the home is sold prior to five years or is given up as main residence of the owner, the fee shall be paid retrospectively.
