In response to our client's question “whether a handwritten last will and testament should be legible”, Dr. Friedrich Schwank and Mag. Daniela Lederer would like to point out typical mistakes in testamentary dispositions. Inheriting should also be learned!
Writing should definitely be legible!
The Will should be written by the testator’s/testatrix’s hand and signed by hand
The testator should sign as he usually does (either his/her name or “Your mother”, “Your father” etc.)
If more of one page each page has to be signed
The date should be specified
Witnesses are not required at all
In order to avoid formal mistakes as well as mistakes in content, which may make a the Will (completely or partly) invalid, legal advice from a notary public or lawyer should be sought.
