HANDWRITTEN LAST WILL AND TESTAMENT

In response to our client's question “whether a handwritten last will and testament should be legible”, Dr. Friedrich Schwank and Mag. Daniela Lederer would like to point out typical mistakes in testamentary dispositions. Inheriting should also be learned!


  • Writing should definitely be legible!

  • The Will should be written by the testator’s/testatrix’s hand and signed by hand

  • The testator should sign as he usually does (either his/her name or “Your mother”, “Your father” etc.)

  • If more of one page each page has to be signed

  • The date should be specified 

  • Witnesses are not required at all


In order to avoid formal mistakes as well as mistakes in content, which may make a the Will (completely or partly) invalid, legal advice from a notary public or lawyer should be sought.
